What are FLSA and Overtime Laws in Arkansas?
The Fair Labor Standards Act (FLSA) overlaps Arkansas State Labor Laws in many areas, one of which is laws regulating what qualifies as overtime and what is fair overtime pay.
State law and the FLSA state that overtime is any time worked over the 40 hour work week. In cases of on-call employees, overtime can be anytime an employee is called out for work after 5 PM during the work week. Overtime pay in the state of Arkansas is time and a half, or the employee’s regular pay rate time 1.5. For example, if your hourly rate is $10 per hour, the overtime rate would be $15 per hour. Its important for all employees to track the amount of hours worked and verify each paycheck with the exact amount they are entitled to receive.
There are some exemptions, however, to the overtime laws.
